16.5 Million Dollar result in Medical Malpractice Paralysis case

A jury has found in favor of a California couple in their hospital malpractice lawsuit alleging Trent Hughes was neglected after he suffered injury from an accident while he was off-roading.

Hughes was airlifted to the hospital after his accident in November 2003, from which he had suffered a fractured spine.  Shockingly he was not seen by on-call neurosurgeon Christopher Pham until the following day and did not undergo much needed surgery until two days after he suffered the injury.

As a result of the hospital’s negligence Hughes is now a paraplegic.  He and his wife were suing for medical expenses, past and future lost earnings, and pain and suffering.

The jury spent eight hours deliberating after hearing testimony from both sides, and came back with a verdict for the plaintiffs.  They were awarded $16.5 million.

It is unknown exactly why Hughes was not treated in a timely manner, but seems to be a clear cut case of medical negligence.  When hospital personnel fail in the duties, the results can be nothing short of devastating.  Victims of hospital malpractice have the right to seek justice for themselves, their families and to receive compensation for their losses.
