Hospital Sued in Wrongful Death Lawsuit

A wrongful death lawsuit has been filed against a California hospital claiming that Penny Louise Prevezich died as a direct result of the hospital staff’s negligence.

Penny’s daughter, who filed the suit, claims that her mother was left unattended in the waiting area of the hospital for 90 minutes after being transported there by paramedics for an undisclosed condition.  When Prevezich was finally checked on, she was found slouched over and not breathing.  She was in cardiac arrest and unfortunately, did not recover.  She was pronounced dead just over two hours following her arrival.

According to records, Ms. Prevezich’s “psychiatric history was well-known to the staff” at San Mateo Medical Center.  It’s unclear whether this had something to do with their lack of attention to her.  The wrongful death lawsuit states that the hospital has left Prevezich’s daughter “deprived of a kind and loving mother”.

Regardless of past circumstances, it is the duty of hospital personnel to treat each patient, and each visit, with care and priority.  Had the staff in San Mateo done so, Ms. Prevezich would likely still be alive today.

The death of a 10 year old British boy is being blamed on medical malpractice and has caused quite a stir among the medical community there and across the globe.

Kieran Howard’s problems started with a simple sneeze at his home last March, which inadvertently caused a tumor in his brain to burst.  He was taken to the hospital where, instead of being properly tested and monitored, he was made to wait some 12 hours and moved between three medical facilities before he finally died as a result of his condition.

Coroner, Dr. Fiona Wilcox, who performed the autopsy on the boy says he would be alive today had his condition been properly diagnosed in time and the life-saving surgery he required had been performed.  Dr. Wilcox cited the hospital staff with neglect, and called the whole situation a “gross failure”.

Neither the hospital, nor its staff has offered any explanation as to why Howard was so severely neglected.  There is also no report yet on whether the family plans to file a medical malpractice lawsuit, although it is more likely than not that they will.

Man Sues Hospital for Medical Malpractice

A St. Louis man who went to St. Luke’s Hospital for treatment of his renal disease is now suing them for medical malpractice claiming they are responsible for his developing a rare disorder referred to as nephrogenic systemic fibrosis.

Between 2004 and 2007, the plaintiff underwent several MRI’s at the hospital, most of which involved the use of a gadolinium-based contrast dye.  Following these imaging studies, the man began developing lesions on his skin and fibrosis of his arms, legs, feet and hands.

He was officially diagnosed with nephrogenic systemic fibrosis, a painful and debilitating disease that is incurable and often fatal.

The medical malpractice lawsuit alleges that the hospital was negligent in administering the contrast dye in a patient who was in renal failure, which according to the suit is the underlying cause of the plaintiff’s new condition.  It also mentions the makers of the dyes, claiming that they designed a defective product and knowingly misrepresented that product as safe when it was not.

The plaintiff is suing for actual expenses (medical expenses, lost wages, etc.) as well as punitive damages for his pain and suffering.

Wrongful Death Lawsuit Filed in Fatal Hospital Bed Fall

The son of an 83 year old West Virginia woman has filed a wrongful death lawsuit claiming she died as a result of injuries suffered after falling out of her hospital bed.

Richard Hornick’s mother, Mary, passed away just months after she fell from her hospital bed while she was a patient at the Thomas Memorial Hospital.  His lawsuit claims that her fall was as a result of the negligence of hospital staff.

On December 8, 2007, while Ms. Hornick was an inpatient at the hospital, she was not properly monitored by staff and tumbled from her bed as a result.  The fall caused severe bruising, cuts on her head and arm and a hematoma.  The lawsuit claims that Ms. Hornick should have been monitored more closely because she met the hospital’s high-risk category.

Six months later, the victim died at a nursing facility.  The cause of her death was determined to be primarily due to dementia, but the secondary cause was listed as a cerebrovascular accident, in other words, the fall.

Hospital falls can be so dangerous that the FDA has released a guide to hospital bed safety.
